Welcome to the VLearn Platform

at https://vlearn.co.in/login (“Platform”), offered and operated by Isotonic Solutions Inc.. (“VLearn”, “we”, “our” or “us”). The Platform is offered to United States-based workers who are 18 years old or older and meet certain qualifications (“you” or “your”). The Platform is offered as part of an entry in a prize competition sponsored by XPRIZE to develop rapid job retraining programs known as the XPRIZE Rapid Reskilling Competition, see https://www.xprize.org/prizes/rapidreskilling (the “Competition”).

This Privacy Policy describes how VLearn collects, uses, stores, and shares your information when:

You access and/or use the Platform
You communicate with us in any way regarding the Platform (“Communications”); and/or
We obtain your information through third-party providers, public databases, or other related third-party sources (“Third Parties”).

1. ACCEPTANCE OF THIS AGREEMENT

Please read this Privacy Policy carefully. The practices described herein are subject to the laws in the places in which we operate.

BY ACCESSING AND/OR USING THE PLATFORM, YOU REPRESENT THAT YOU HAVE READ AND UNDERSTOOD THIS PRIVACY POLICY.

What Type of Information Do We Collect About You, and How Do We Collect It?

Depending upon how you interact with the Platform and our Communications, and our interactions with Third Parties, we may collect your information:

Your e-mail address (username), password, and other contact information you provide when signing up for, and creating an account with, the Platform;
Details of your use of and interaction with the Platform;
Any information you provide to us when you report a problem with the Platform;
Records and copies of your correspondence (e.g., email address) if you contact us regarding the Platform;
Your responses to surveys that we might ask you to complete; and
Your search queries on the Platform.

Details of your visits to the Platform, including traffic data, location data, logs and other communication data;
Details regarding your participation and performance on the Platform, which may include your name, contact information, identification code assigned to you, retraining start and end dates, the modules you accessed and used, the time it took for you to learn, and diagnostic data such as motivation level, empathy, task-orientation and memory retention;
Information about your computer and mobile device, and internet connection, including your IP address, operating system, and browser type; and
Interactivity with e-mails from us, including opening, navigating, and click-through information.

Third Party Service Providers, including but not limited to internet service providers, fraud prevention services, and related partners;
Our collaborators, including certain Colleges and research organizations;
oPublicly available information from public sources, including local, state, and federal government agencies and departments, and other related databases recognized under applicable law as publicly available information.

How Do We Use Your Information?

Depending on where you live and how you interact with the Platform, the nature of your Communications, and the types of Third Parties with whom we interact, we may use your information to:

Provide the Platform to you;
Notify you about changes to the Platform;
Analyze your eligibility for use of the Platform;
Facilitate your participation in the Platform;
Enforce our terms, conditions, and policies, and those of the community colleges and universities based in the US (“Colleges”) providing training content;
Personalize content you receive and provide you with tailored content;
Communicate with you;
Perform data analytics (including market research, trend analysis, financial analysis);
Identify and protect against fraud and/or other criminal activity, claims and other liabilities;
Comply with legal obligations and/or other lawful requirements, whether by law or by contract.

To the extent feasible, we restrict access of your information to our employees, agents, or contractors who have a legitimate business need for such access. Specific instructions or requirements for handling personal information are communicated to employees to whom personal information is disclosed. Personal information is disclosed only to employees who have signed non-disclosure agreements to protect personal information in a manner consistent with the relevant aspects of the Privacy Policy or other specific instructions or requirements. We also have procedures in place to evaluate whether the Third Parties have effective controls to meet the terms of our agreements, instructions, or requirements.

How Do We Share Your Information?

How Do We Share Your Information?

We do not sell your information. We may, however, disclose or share your information:

With others involved in the Competition. We may disclose or share your information with XPRIZE; XPRIZE’s Advisory Board for the Competition; and the Judging Panel appointed by XPRIZE to judge the Competition; and we may disclose or share anonymous usage information with the Colleges who provide content for the retraining modules. All of the foregoing will be under confidentiality obligations.
To our service providers, subsidiaries and affiliates. We may disclose or share your information with our service providers, subsidiaries and affiliates, who are under confidentiality obligations, to further facilitate your use of the Platform, and to ensure the smooth and consistent operations of the Platform by identifying and repairing errors that impede intended functionality and to protect against malicious, deceptive, fraudulent, or illegal activity.
With your consent. e may disclose or share your information with your consent. We may obtain your consent in writing; online, through “click-through” agreements; when you accept the End User Access Agreement for use of the Platform; orally, either in person or on the phone; or by other means.
In a business transfer We may disclose or share your information as part of a merger of acquisition with or by another team in the Competition; a corporate business transaction, such as a merger or acquisition, joint venture, corporate reorganization, financing, or sale of company assets; or in the unlikely event of insolvency, bankruptcy, or receivership, in which cases such information could be transferred to third parties as a business asset in the transaction.
For legal process and protectionWe may disclose or share your information to satisfy any law, regulation, legal process, governmental request, or where we have a good faith belief that access, use, preservation or disclosure of such information is reasonably necessary to:

Enforce or apply agreements, or initiate, render, bill, and collect for our services;
Protect our rights or interests, property or safety or that of others;
In connection with claims, disputes, or litigation - in court or elsewhere;
Protect users of our Platform and other carriers or providers from fraudulent, abusive, or unlawful use of, or subscription to, such services; and
Facilitate or verify the appropriate calculation of taxes, fees, or other obligations due to a local, state, or federal government.

Discussions with Other Platform Users

From time to time, the Platform may provide you with the opportunity to communicate with other workers seeking job retraining, discussion sessions with tutors, student advisors, recruiter and potential employers, and/or other message or communications methods (“Discussion Services”). If you use these functions, your submissions to the Platform or messages and materials you may send or receive may be or become available to others on the Platform and elsewhere. You should only post, send, and receive messages through these forums that are appropriate to the Platform, not confidential or private, and relate to the service you are interacting with.

Links to Sites of Others

The Platform may contain links to websites, apps or resources of third parties, including awarding VLearn Coins for certain steps taken through the Platform which may involve coupons or gift cards that may be redeemed with local businesses. Please note that these links and awards are provided for your use, convenience and information, and the websites, apps or resources may operate independently from us and have their own privacy policies or notices, which we strongly suggest you review. This Privacy Policy applies to our Platform, and we do not accept any responsibility or liability for the policies or practices of any third parties. Any postings, links or awards do not imply our endorsement of any third-party or its information, products, services, website, apps or resources, or such third party’s endorsement of us or the Platform.

Third Party Tracking / Do Not Track

We may, from time to time, collect information about your online activities, over time and across our Platform. When you use our Platform, Third Parties may also collect information about your online activities, over time and across different internet websites, online or cloud computing services, online applications, or mobile applications. Some browsers support a “Do Not Track” feature, which is intended to be a signal to websites that you do not wish to be tracked across different websites you visit. Our Sites do not currently change the way they operate based upon detection of a “Do Not Track” or similar signal.

How Do We Store and Protect Your Information?

Although no system can guarantee the complete security of your information, we take all commercially reasonable steps to ensure your information is protected in alignment with all applicable laws and regulations, as appropriate to the sensitivity of your information.

How Long Do We Keep Your Information?

After you complete your training or cease use of the Platform, we may store and use for research purposes information about your use of the Platform only under the identification code assigned to you, and will remove your personal information to anonymize the record. We keep your information for as long as necessary in accordance with the purpose for which it was collected, our business needs, and our legal and regulatory obligations. If we dispose of your information, we will do so in a way that is secure and appropriate to nature of the information subject to disposal.

Cookies and Related Technology

We may use cookies (browser and flash), beacons, pixel tags, scripts, and other similar technologies from time to time to support the functionality of the Platform. A cookie is a piece of information contained in a very small text file that is stored in your Internet browser or elsewhere on your hard drive. Cookies are transferred from the Platform to your computer, phone or tablet, and allow us to identify your device whenever you return to the Platform. These technologies provide a better experience when you use the Platform, and allow us to improve our services. We may also use analytic software to better understand how the Platform functions on your device(s) and for other analytical purposes. .

That cookie then communicates with servers of ours or those of other companies that we authorize to collect data for us and allows recognition of your personal computer. Certain features of the Platform may use locally stored objects called flash cookies to collect and store information about your preferences and navigation to, from and on the Platform. We also may include cookies to provide aggregate reporting. The Platform may allow Adobe to set and enable special cookies that are necessary to deliver video content for Adobe Flash Player. You cannot remove flash cookies simply by changing your browser settings. Beacons.

The Platform and our e-mails may contain small electronic files known as beacons (also referred to as web beacons, clear GIFs, pixel tags and single-pixel GIFs) that permit us, for example, to count users who have visited those pages or opened an e-mail and for other website-related statistics. Beacons in our e-mail communications may allow us to track your responses and your actions. You may use the tools in your device to disable these technologies as well.

We and our service providers may also use cookies and beacons to collect anonymous information about your activities through our Platform, which we may share on an anonymous basis with researchers and others.

Your Choices.

You may wish to restrict the use of cookies or completely prevent them from being set. Most browsers provide for ways to control cookie behavior, such as the length of time they are stored. We provide you the ability to exercise certain controls and choices regarding your information. We will respond to your request as possible and in accordance with all applicable laws and regulations. You may submit your request directly, or through an authorized agent, subject to additional verification of your identity and/or the agent’s authorization. To protect your identity, we may also use reasonable efforts, consistent with applicable law, to verify your identity before responding to your request.

Correct Your Information. If you believe we have incorrect or inaccurate information about you, we will use reasonable efforts to allow you to update or correct the information we collect from and about you. Please note, some data we may have about you comes from Third Party sources, from which we cannot amend the information. For those Third Party sources, you will need to submit your request directly to the original source of the information.
Access Your Information.Subject to the laws in the jurisdictions in which you live and we operate, you may have a right to know what information we have collected about or from you, how that information is being used, and with whom it is being shared. Please note, this right may not extend to publicly available information that is linked to through the Platform. Depending on where you live, you may also be entitled to receive a copy of your information.
Delete Your Information.Subject to the laws in the jurisdictions in which you live and we operate, and subject to certain exceptions recognized by applicable law, you may have a right to ask that we delete your information.
Object to Certain Uses.Subject to the laws in the jurisdictions in which you live and we operate, you may have the right to tell us to stop processing your information for certain purposes.

Non-Discrimination.

We will not discriminate against you for exercising any of your rights under applicable law and this section. That means if you exercise any of your rights in connection with your information, we will not deny you access or use of the Platform, charge you a different price or rate for the Platform, or provide you a different level of service, subject to exceptions under applicable law.

Children

The Platform is not intended for children under the age of 18. This includes any links to other websites that we provide for our convenience. We don’t knowingly collect the information of children for any reason.

International Jurisdictions

The Platform is hosted and offered in the United States of America (US), and is subject to US federal, state, and local law. If you are accessing the Platform from another country, please be advised that you may be transferring your information to us in the US, and you consent to that transfer and use of your information in accordance with this Policy. You also agree to abide by the applicable US federal, state, and local laws concerning your use of the Platform, and your agreements with us. Any person accessing the Platform from any jurisdiction with laws or regulations governing the use of the Internet, including the collection, use, or disclosure of information, different from those of the jurisdictions mentioned above may only use the Platform in a manner lawful in their jurisdiction. If your use of the Platform would be unlawful in your jurisdiction, you may not use the Platform.

We may change this Policy from time to time. Any changes will be reflected on this page, and where appropriate or required by law we also will notify you by other means. The effective date will be stated at the top of this Policy. You should regularly check this page for any changes to this Privacy Policy. Your continued use, access, or interaction with the PLATFORM, or your continued communications with us after the updated POLICY has been posted, will REPRESENT THAT YOU HAVE READ AND UNDERSTOOD THIS POLICY AS IT APPLIES TO THOSE CONTINUED COMMUNICATIONS.
